Terms of Use

These Terms of Use govern your access to and use of the Strato Curated Collective website and services.

This page is maintained by Strato Curated Collective, a d/b/a of Variety Strategic Travel Solutions LLC (Kilgore, Texas), to describe our current policies and disclosures. It is provided for information only and is not legal advice. For questions, contact info@stratocurated.com.

These Terms of Use (“Terms”) form a binding agreement between you and Variety Strategic Travel Solutions LLC, a Texas limited liability company, doing business as Strato Curated Collective (“Strato,” “we,” “us”), with an office at 1100 Stone Rd, Suite 118, Kilgore, TX 75662. By using stratocurated.com or any of our portals, you agree to these Terms.

1. Who we are and what we do

Strato is an independent travel-planning business. We plan itineraries and, where you engage us to do so, coordinate bookings with third-party travel suppliers (airlines, hotels, cruise lines, tour and transfer operators, insurers, and similar). Strato is not a supplier and does not itself provide transportation, accommodations, or travel services. Suppliers are independent contractors and their own terms, tariffs, and conditions govern the services they provide.

2. Eligibility and restricted states

You must be 18 or older to create an account or engage our services. We do not currently accept clients whose primary residence, billing address, or business address is in California, Florida, Washington, or Hawaii. See Seller of Travel Disclosures.

3. Quotes, planning fees, deposits, and payment

Written quotes are valid until the expiration shown on the quote, computed in U.S. Central Time. Expired quotes must be re-priced. We may require a non-refundable Research & Planning Fee or service fee before we begin work; those fees are for the professional time we spend and are separate from any deposit or payment made to a supplier. Deposits and payments to suppliers are governed by the supplier’s terms and by our Payment Terms and Cancellation & Refund Policy.

4. Supplier terms control

When you purchase from a supplier through Strato, that supplier’s booking terms, fare rules, cancellation policies, tariffs, baggage rules, health/entry requirements, and force-majeure provisions govern the trip. Strato does not control and is not responsible for supplier performance, delay, cancellation, denial of boarding, injury, illness, loss, damage, theft, or any act or omission of any supplier.

5. Documents, passports, and visas

You are responsible for ensuring you have valid passports, visas, vaccinations, health documentation, and any other entry/exit requirements for every jurisdiction on your itinerary. See Passport & Visa Disclosure. Failure to have required documents is not a basis for refund from Strato.

6. Travel insurance

We recommend comprehensive travel insurance. See Travel Insurance Disclosure. Declining insurance is at your own risk.

7. Acceptable use

Do not use our website or portals to (a) violate any law or third-party right; (b) attempt to access accounts or data that are not yours; (c) interfere with security features or usage limits; (d) transmit malicious code; (e) scrape or bulk-download content; (f) impersonate anyone; or (g) misuse the platform to defraud clients, agents, or suppliers.

8. Accounts and security

You are responsible for maintaining the confidentiality of your login, for all activity under your account, and for keeping your email address current. Notify us immediately at info@stratocurated.com if you suspect unauthorized access.

9. Content and intellectual property

The site, portals, itineraries, proposal documents, brand marks, photos, and written content are owned by Strato or its licensors. Except for the limited right to view and use them for your own trip planning, no license is granted. Do not copy, redistribute, or create derivative works without our written permission.

10. Third-party sites and content

Links to third-party sites are provided for convenience. Strato does not control, endorse, or assume responsibility for third-party content or practices.

11. Assumption of travel risk

Travel involves inherent risks, including but not limited to transportation, weather, illness, political instability, criminal activity, and force majeure. You knowingly and voluntarily assume all such risks.

12. Disclaimer of warranties

The website and services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that services will be uninterrupted or error-free.

13. Limitation of liability

To the maximum extent permitted by law, Strato and its owners, officers, employees, and independent agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data, arising out of or related to your use of the website, portals, or services. Our total cumulative liability for any claim arising out of or related to these Terms or your use of our services is limited to the greater of (a) the Research & Planning or service fees you paid to Strato in the six months before the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100). This limit does not apply to liability that cannot be limited or excluded under applicable law.

14. Indemnification

You will defend, indemnify, and hold harmless Strato and its representatives from and against claims, damages, liabilities, losses, and reasonable attorneys’ fees arising out of (a) your breach of these Terms; (b) your misuse of the website or portals; or (c) your violation of law or third-party rights.

15. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. The exclusive venue for any dispute that cannot be resolved informally is the state or federal courts located in Gregg County, Texas. Before filing suit, you agree to give us at least 30 days’ written notice at info@stratocurated.com and a good-faith opportunity to resolve the matter. Nothing in this section prevents either party from bringing an individual claim in a court of competent small-claims jurisdiction.

17. Changes

We may update these Terms from time to time. Material changes will be posted with a new effective date. Continued use of the website or services after the effective date constitutes acceptance of the updated Terms.

18. Miscellaneous

If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, sale, or reorganization. These Terms, together with the referenced policies and any signed client agreement, are the entire agreement between you and Strato regarding the subject matter.
